Terms of use

1. Purpose

These terms of use (the "Terms") govern access to and use of the Africa Customer Week application (the "Application"), provided by the TotalEnergies Marketing subsidiary of your country ("TotalEnergies") to run the Africa Customer Week campaign across its service station network.

Access to the Application requires unreserved acceptance of these Terms and of the privacy policy. If you decline them, you cannot use the Application.

2. Users

The Application is reserved for:

• service station staff of the TotalEnergies network (managers, forecourt supervisors, pump attendants, cashiers, etc.);
• TotalEnergies staff assigned to a department;
• persons authorised by TotalEnergies to administer or supervise the campaign.

Every account is subject to approval by an authorised manager. TotalEnergies may refuse, suspend or deactivate an account at any time, in particular when a user leaves or breaches these Terms.

3. Account and credentials

You sign in with your phone number or email address and a personal password. Your credentials are strictly personal and confidential: you must not disclose or share them, nor use another person's account.

You are responsible for every action performed from your account. If your credentials are lost or you suspect fraudulent use, change your password immediately and inform your manager.

Verification codes sent by SMS or email are personal and must never be given to anyone, including a person claiming to work for TotalEnergies.

4. Use of the Application

You agree to use the Application only within the scope of your duties and of the Africa Customer Week campaign, and in particular to:

• record accurate information;
• register a customer only with their agreement, after informing them of how their data is used and, where applicable, obtaining their consent to receive SMS or emails;
• not create fictitious customers, artificially inflate results or misuse promotional codes;
• not extract, copy or disclose data from the Application outside authorised uses;
• not attempt to access data or features you are not authorised to use, nor disrupt the Application.

Any fraud may lead to the cancellation of the results concerned, deactivation of the account and, where appropriate, disciplinary measures or legal action.

5. Customer data

Customer data you record (first and last name, phone, email, consents, survey answers) is confidential. You must use it only for the campaign and never disclose it to third parties. Data exports are reserved for authorised persons and must be stored securely, then deleted when no longer needed.

6. Availability

TotalEnergies endeavours to keep the Application available at all times, without any guarantee. Access may be interrupted for maintenance, updates or in case of force majeure. TotalEnergies cannot be held liable for temporary unavailability or mobile network outages.

7. Intellectual property

The Application, its content, trademarks and logos are the property of TotalEnergies or its partners. No reproduction or use beyond what these Terms allow is permitted.

8. Personal data

The processing of your personal data and of customer data is described in the privacy policy, which forms an integral part of these Terms.

9. Changes to the Terms

TotalEnergies may amend these Terms. Any new version will be presented to you at your next sign-in and must be accepted to keep using the Application.

10. Governing law

These Terms are governed by the law of the country of the TotalEnergies subsidiary concerned. Failing an amicable settlement, any dispute shall be submitted to the competent courts of that country.
